7. Blyth v Birmingham waterworks 1856
Facts: A wooden plug in a water main became loose in a severe frost. The plug led to a pipe which in turn went up to the street. However, this pipe was blocked with ice and the water instead flooded the claimant’s house.
Ratio: “Negligence is the omission to do something which a reasonable man
guided upon those considerations which ordinarily regulate the conduct of
human affairs, would do, or something which a prudent and reasonable
man would not do” - Baron Alderson.
Outcome : Negligence claim failed- D followed reasonable precautions
Relevance: Set the definition of negligence.

How can you not forsee a fire risk when welding surrounded by oil which is flammable?
The Defendants were not the ones welding they just caused the oil spill. The defendants are only responsible for any damage that one can expect from a oil spill as this was what they contributed. They could not foresee someone would be welding and the water would catch fire.
I was so lost in class and did not know how to fully make the information I have quantifiable. I had a simple question and all this information but did not know how to explain it. This gave me a great 'framework' on how to answer the questions in my assignment. The breakdown is absolutely great - I appreciate this video dearly.
Then the court can say whatever they want to link MR and AR together. Is there any way for the defendant to escape liability?
Do we need to apply 'but for' test in occupier's liability?
Can restaurant or any other local business create a bylaw?
They could in theory if they had the authority from Parliament to do so. However, I cannot think of any examples where Parliament delegated authority to a restaurant.
